Your Brand Is Yours. Until It's Legally On Record

Your name, logo, and packaging are how customers recognize you. But recognition and legal rights are two different things. Until a trademark is registered, anyone can file for the same name before you do — and you can lose the right to operate under your own brand. At Edeal we register trademarks in the US through a licensed American attorney and help protect your brand in other countries. We run the full cycle — from checking the name to the certificate and beyond.

Why Register a Trademark

Registration isn't a formality — it turns your brand into an asset that's protected by law and that you can put to work.

  • Name protection. Once registered with USPTO, your rights to the mark apply nationwide. A competitor can no longer claim they "didn't know" about your brand.
  • Amazon access. Without a trademark you can't enroll in Amazon Brand Registry — and without it most of the platform's brand tools are closed to you (more below).
  • Business value. Companies with registered marks are worth more at sale. That's standard in business valuation.
  • An asset that works. A mark can be licensed, transferred, or held in a holding structure. How larger companies do it — in a separate article on trademarks and tax.

A Trademark Is Required for Amazon

We break this out separately because it's the single most common reason people come to us. To get Amazon Brand Registry, your brand needs a registered trademark or an application filed in a specific way. Without Brand Registry, a seller loses access to many of the platform's key features:

  • A+ Content and Premium A+ — enhanced product pages with photos, video, and comparison tables. Amazon cites sales lifts of up to +20%.
  • Brand Analytics — search-term analytics, funnels, repeat-purchase data, and buyer demographics.
  • Amazon Store — a free branded storefront.
  • Sponsored Brands — ads with your logo and banner at the top of search results, available only to brands.
  • Protection tools — Report a Violation, automated counterfeit takedowns, Transparency, Project Zero.
  • Brand Referral Bonus, Vine, Brand Tailored Promotions and other brand-only programs.

A full breakdown of every feature is in the article "Amazon Brand Registry: What a Trademark Gives a Seller".

You don't have to wait for the certificate. To enroll in Brand Registry, a filed USPTO application serial number is enough. That means brand tools open up shortly after filing, not a year later when the certificate arrives. We file the application and hand you the number for enrollment.

Why Us, Not Amazon IP Accelerator

Amazon has its own program, IP Accelerator — a network of partner law firms. The difference is in the approach:

  • Fully transparent. You know upfront what the work includes and what happens at every step. No surprises along the way.
  • Turnkey. We run the entire cycle — from checking the name to Brand Registry enrollment and ongoing maintenance — not just a slice of it.
  • No hidden fees. Clear pricing, no extra invoices popping up as you go.
  • We guide you by the hand. You work with real people who explain and advise, not an impersonal form on a website.

We Register Marks Worldwide

We don't work in the US only — we can protect your brand in virtually any country in the world.

  • US (USPTO) — the core scenario. Registration through a licensed American attorney.
  • Other countries — Canada, the EU, the UK, China, and other markets are registered separately; a US mark protects you only in the US.
  • Madrid Protocol — a single application covering 100+ countries. More expensive than one registration, but cheaper than filing in each country separately. Useful if you sell across several markets at once.
  • China — separately. It's a first-to-file jurisdiction: rights go to whoever files first. There are documented cases where someone else's brand was registered before the owner arrived. If you're planning manufacturing or sales in China, file early.

How the Process Works

We guide you by the hand — you're never left alone with a form on a website. Here's how the work goes:

  1. Consultation with the attorney — 30 minutes. We start with a real conversation. We discuss your brand, where and how you sell, and your plans for different markets. At this stage the obvious risks are already visible.
  2. In-depth analysis. We check the name against the USPTO database and international databases in your category. "Similar" in the offices' view is broader than it seems: two marks can sound different yet still conflict. The analysis shows your real odds.
  3. Alignment and recommendations. We come back to you with conclusions: file as is, adjust the name or spelling, add or remove goods classes. Descriptive names like "Premium Quality" are hard to defend — we advise how to strengthen the mark before filing. Everything is agreed with you; nothing is filed blind.
  4. Filing. We file the application — use-based (you're already selling) or intent-to-use (you're planning to). You immediately receive a serial number for Amazon Brand Registry enrollment.
  5. Managing examination. USPTO examination takes about 8–12 months. We respond directly to examiner office actions — which saves time.
  6. Publication and certificate. After examination comes publication and a 30-day window for third-party oppositions. Then the certificate. The mark is valid for 10 years, renewable thereafter.
  7. Maintenance. We remind you about renewal at year 5 and year 10 (Section 8 / Section 9). This isn't "file and forget": missed deadlines cancel the mark.

At every step you work with a real specialist, not a bot.

What the Service Covers

  • preliminary search of similar marks (USPTO TESS and state registers);
  • strength assessment and class selection;
  • filing (use-based or intent-to-use);
  • responses to office actions during examination;
  • if needed — opposition or defense in disputes with third parties;
  • Amazon Brand Registry enrollment once the serial number is issued;
  • if needed — Madrid Protocol for international protection via one application;
  • renewal reminders at year 5 and year 10.

Frequently Asked Questions

Is a trademark required for Amazon?

Yes. To enroll in Brand Registry you need a registered mark or an application filed in a specific way. Without Brand Registry, most of the platform's brand tools are closed to you.

Do I need to wait for the certificate to join Brand Registry?

No. A filed USPTO application serial number is enough — brand tools open up shortly after filing.

How are you different from Amazon IP Accelerator?

We run the full cycle turnkey, everything is transparent and there are no hidden fees, and we guide you by the hand — you work with real specialists, not a form on a website.

Does US registration protect me abroad?

No. A US mark is valid only in the US. Other countries require separate registration or the Madrid Protocol.

What if my name is too generic?

Descriptive names are hard to register and almost impossible to defend. During the search stage we assess the strength of the mark and advise how to strengthen it.

How long does US registration take?

USPTO examination takes about 8–12 months. The serial number for Amazon is issued right after filing.

Do I need a US company to register a mark?

We run the full cycle for clients with US LLCs and Corps. If you don't have a company yet, we'll help you open one.

Protect your brand — in the US and abroad?
